They compensate a woman who tripped over a sunken manhole cover in Llanes with more than 3,000 euros

The victim filed a claim after suffering, as a result of the fall, a fracture in her arm, a sprained ankle and persistent pain in her shoulder.

The Plenary Session of the Advisory Council of the Principality of Asturias has issued a ruling that requires the Llanes City Council to compensate a person with 3,733.26 euros for the injuries that occurred when he tripped over a manhole cover that was sunken in a street in the capital of the council. The fall caused injuries from which it took him 102 days to heal. In addition, he has been left with mild pain in his shoulder.

The accident took place in April 2022. Subsequently, the woman filed a property liability claim for the damages suffered, which she valued at 7,466.51 euros. The Local Police report, which accompanies the claim, states that the patrol arrived at the scene and observed a group of people helping the woman, "who shows severe pain in her left shoulder (...), having (...) to be transferred to the Health Center. And the medical report states that she suffered a "non-displaced fracture of the neck of the humerus" and also "sprained left ankle, in which an 'avulsion fracture of the left fibula' was detected after an imaging test."

The Llanes City Council accepted the claim for processing and, in addition, was responsible for repairing the manhole in poor condition. Lee agreed with the plaintiff and proposed a resolution in an estimatory sense, considering "it is proven that the injury suffered by the claimant is a consequence of the operation of public services" and asked the Advisory Council for an opinion on patrimonial liability.
