Civil Liability and the Impact of Artificial Intelligence on Insurance

This new regulatory and technological scenario directly affects insurance coverages, from General RC to Professional RC, through D&O and cyber risks.

D&O: The use of AI systems in strategic decision-making can generate claims if oversight failures, biases in algorithms or misjudged investments in technology companies are detected.
RC General: Manufacturers face claims in the event of damages caused by defective products with integrated AI, such as autonomous vehicles, medical devices or financial management software.
Professional RC: Professionals who support their services in AI, for example, lawyers, doctors, economists or tax advisors, may be liable for damages arising from misdiagnoses, inadequate interpretations or wrong calculations.
Cyber risk: Failures in AI systems designed to detect attacks or automate responses can amplify security incidents, with serious consequences in both liability to third parties and own losses.
These scenarios broaden the spectrum of risks to be covered and make the drafting of appropriate contractual agreements, as well as the adaptation of insurance conditionals to the new realities of insureds, even more relevant.

AI as a tool, not a substitute
AI is, without a doubt, a powerful tool, but it does not replace human judgment. Its implementation requires supervision, organization and, above all, common sense. As insurers, we see it as essential to have a sound regulatory framework and professionals capable of challenging, validating and improving AI systems.

At Allianz we accompany our customers through this process, reviewing and adjusting our coverages to reflect the emerging risks associated with digitization and artificial intelligence. We firmly believe that technology should serve to enhance human capabilities, not replace them, and that civil liability arising from its use can only be effectively managed by combining innovation, regulation and prudence.
