China's civil code project to improve civil liability system: Experts

BEIJING, May 19 (Xinhua) - A draft civil code to be submitted to the annual session of China's top national legislative body for review will strengthen the civil liability system, experts said.
The draft civil code includes general provisions and six parts referring to property, contracts, individual rights, marriage and family, inheritance and civil liability.
The civil liability section of the draft civil code makes a necessary improvement to the civil liability system by taking advantage of the useful practices of judicial interpretations, said Shen Chunyao, director of the Legislative Affairs Commission of the Standing Committee of the National People's Congress.
In particular, it improves the compensation system for inflicting mental anguish and broadens the application of that compensation, showing that China's laws are paying more attention to protecting mental and individual rights, said Meng Qiang, a law professor. from the Beijing Institute of Technology.
The experts also referred to enhanced protection for consumers who purchase defective products. The introduction of punitive damages for infringement of intellectual property rights is also considered as one of the highlights of the civil liability part of the project.
